Violations

The Board of Directors has a duty to strictly enforce the Association’s Governing Legal Documents to preserve the attractiveness and harmony of the entire community. The Board’s duty to the members of the Association requires the Board to investigate and take action to correct violation reported or discovered. The Declaration authorizes the Association to assess fines against members if the violations identified are not corrected within ten (10) days of the date of notice, pursuant to Article XI of the Declaration. The Association shall assess fines in the amount of $25 per day per violation for each violation identified. The fines levied against members shall be the member’s personal obligation and can constitute a lien against a member’s property. Fines will continue to accrue until violations are remedied.

In addition to the assessment of fines, the Declaration authorizes the Association to use self help to correct violations, and the Association may do so if the violations identified are not corrected within ten (10) days of the date of notice. If a violation is not corrected within ten (10) days of the date of notice, the Association may enter a member’s lot, correct the violations and assess those costs against the member under Article XI, Section 4 of the Declaration. In addition to fines and self-help, the Association may proceed to file a lawsuit or in equity to obtain your compliance with the Declaration, Bylaws, and Architectural Modification Guidelines.

If a member wishes to challenge the fact of the occurrence of the violations, the proposed sanctions, or both, the member may do so by sending a written notice to the Board at Ellington HOA, 345 Greenway Drive, Covington GA 30016. The written notice must be received at the above address within ten (10) days from the date of notice. Members are invited to produce any statement, evidence and witnesses on their behalf. If a member fails to request a hearing within the ten (10) day period, all rights to have the fines reconsidered are waived.
